Information for Whistleblowers Reporting Illegal Conduct Pursuant to Act No. 171/2023 Coll. Statement on the Implementation of the EU Whistleblowing Directive.

In accordance with EU Directive No. 2019/1937 of October 23, 2019, on the protection of persons who report violations of Union law, effective as of December 17, 2021, and in accordance with Act No. 171/2023 Coll., on the Protection of Whistleblowers, the company is introducing Ostendorf - OSMA, Ltd., Komorovice 1, 396 01 Humpolec, as the obligated entity, has established the following procedures and rules for reporting misconduct.

The company has developed an internal policy that establishes an internal reporting system—a set of procedures for receiving reports, recording and processing them, protecting the identity of the reporter, and safeguarding the information contained in the reports.

How to File a Report

Anyone who, in connection with their work or other similar activities, becomes aware of possible unlawful conduct that has occurred or is about to occur may file a report. Choose the method that works best for you.

How Notifications Are Processed

Receipt of Notification

The notice will be received by the designated person. No one else may view it, and that person is bound by confidentiality.

Notice

The authorized person will notify you of the receipt of the notification in accordance with Section 12(2) of the Act.

Assessment of Merits

The designated official will assess whether the report is justified and will notify you of the outcome in accordance with Section 12(3).

Correction

If the report is justified, the designated person will propose corrective measures. You will be notified in writing of the decision.

What You Should Know

  • A whistleblower should act in the public interest and in good faith, believing that the report is based on credible facts.
  • A knowingly false report is a misdemeanor punishable by a fine of up to 50,000 CZK.
  • The identity of the whistleblower is confidential information, and the authorized person is bound by a duty of confidentiality.
  • Whistleblowers are entitled by law to protection against retaliatory measures. The Ministry of Justice outlines the procedure for handling retaliatory measures on its website.
  • Notifications may also be filed with the Ministry of Justice, not just with the company.
  • The company does not accept notifications from individuals who do not perform work or any other similar activity for it under the aforementioned law.
